Terms of Service

These Terms of Service (“Terms”) apply when you visit or shop at SleepCurl (the “Store”), including all related content, features, tools, products and services (the “Services”).

The Store is hosted on Shopify, which provides the e-commerce platform that allows us to sell our products to you.

By accessing or using any part of the Services, you agree to be bound by these Terms and our Privacy Policy, Returns Policy, and Shipping Policy (together, our “Policies”). If you do not agree, you may not use the Services.

1. Eligibility & Account

You must be at least the age of majority in your country of residence to use the Services and place an order. You agree to provide accurate, current, and complete information when placing an order or creating an account. If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

2. Products & Information Accuracy

We make reasonable efforts to display product information as accurately as possible. However, product colours and appearance may vary depending on your device and screen settings. Product descriptions, pricing, and availability may change at any time without notice. We reserve the right to limit quantities or discontinue products at any time. We do not guarantee that products will meet individual preferences beyond what is described on the product page.

3. Orders & Contract Formation

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline any order at our discretion, including in cases of stock unavailability, suspected fraud, payment issues, or obvious pricing errors. A binding agreement is formed only when you receive an order confirmation email and payment has been successfully processed. Orders are intended for personal use. We reserve the right to refuse bulk or commercial resale orders.

4. Prices, Taxes & Payments

Prices are displayed at checkout and may change without notice. You agree to provide valid payment information and authorise us and our payment providers to charge the total order amount, including applicable taxes and shipping fees. If an obvious pricing error occurs, we reserve the right to cancel the order and issue a refund.

Any applicable import duties, customs charges, or local taxes for international orders are the responsibility of the customer, unless otherwise stated at checkout.

5. Shipping & Delivery

Delivery times are estimates and are not guaranteed. We are not responsible for delays caused by carriers, customs procedures, or events beyond our reasonable control. Ownership of the product transfers to you upon delivery at the address provided during checkout, in accordance with applicable consumer law. Further details are set out in our Shipping Policy.

6. Right of Withdrawal (Herroepingsrecht)

If you are a consumer in the EU or UK, you have the right to cancel your order within 14 days of receiving the product, without giving any reason.

However, due to the hygiene nature of our products, the right of withdrawal does not apply to sealed products that have been opened or unsealed after delivery, in accordance with Article 16(e) of the EU Consumer Rights Directive and equivalent UK regulations. Our products are sealed in protective packaging for hygiene reasons. Once this seal has been broken, the product cannot be returned under the right of withdrawal.

To exercise your right of withdrawal for eligible (unopened and sealed) products, you must inform us of your decision by contacting info@sleepcurl.com with a clear statement (for example, a letter sent by post or email). You may use the model withdrawal form provided below, but it is not obligatory.

If you exercise your right of withdrawal, we will provide you with a return label. A flat fee of £5.00 will be deducted from your refund to cover return shipping costs. You must return the goods without undue delay and in any event no later than 14 days from the date on which you communicate your withdrawal. We will reimburse all payments received from you (minus the £5.00 return shipping fee), excluding any delivery costs beyond standard delivery, no later than 14 days from the day we receive the returned goods or evidence that the goods have been sent back.

The right of withdrawal does not apply to items marked as Final Sale or to sealed hygiene products that have been opened after delivery.

7. Returns, Refunds & Exchanges

Returns, refunds, exchanges, eligibility conditions, and any applicable fees are governed by our Returns Policy. Nothing in these Terms affects your statutory rights under Dutch, EU, or UK consumer law.

8. Conformity & Guarantee

Under EU consumer law, products must be in conformity with the contract at the time of delivery. If a product is defective or not as described, you have the right to request a repair, replacement, price reduction, or refund in accordance with applicable law.

Our products are subject to normal wear and deterioration over time. Claims relating to normal wear and tear, improper care, or misuse do not constitute a lack of conformity.

9. Intellectual Property

All content on the Services — including text, images, graphics, logos, product names, designs, videos, and branding — is the property of SleepCurl or its licensors and is protected by intellectual property laws. You may use the Services for personal, non-commercial purposes only. You may not copy, reproduce, modify, distribute, exploit, or use any content without prior written permission. “SleepCurl” and related branding elements are trademarks of SleepCurl. Shopify and its marks belong to Shopify Inc.

10. Third-Party Tools & Services

We may provide access to third-party tools or services. These are provided “as is” and “as available”. We are not responsible for third-party services, their availability, or their content. Your use of third-party services is at your own risk and may be subject to their separate terms and conditions.

11. Third-Party Links

The Services may contain links to third-party websites. We are not responsible for the content, policies, or practices of third-party websites. If you access third-party websites, you do so at your own risk.

12. Relationship with Shopify

The Store is powered by Shopify, but purchases are made directly with SleepCurl. Shopify is not responsible for product sales, deliveries, returns, or disputes between you and SleepCurl.

13. Reviews, Feedback & User Content

If you submit reviews, comments, or other content (“Feedback”), you grant SleepCurl a worldwide, royalty-free, perpetual licence to use, reproduce, publish, and display such content for marketing and business purposes. You confirm that you have the right to submit the content and that the content does not violate third-party rights or applicable law. We reserve the right to remove content at our discretion where legally permitted.

14. Errors & Inaccuracies

Occasionally, the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, or availability. We reserve the right to correct such errors and cancel affected orders at any time.

15. Prohibited Use

You agree not to interfere with or disrupt the Services, attempt unauthorised access to systems or data, transmit malware or harmful code, scrape, crawl, or harvest data without permission, or violate applicable laws or third-party rights. We may suspend or terminate access if these Terms are violated.

16. Disclaimer

To the fullest extent permitted by law, the Services and products are provided “as is” and “as available”. We do not guarantee uninterrupted or error-free access. Nothing in these Terms excludes or limits liability that cannot legally be excluded under Dutch, EU, or UK law.

17. Limitation of Liability

To the fullest extent permitted by law, SleepCurl is not liable for indirect or consequential damages, including loss of profits, revenue, or business opportunities arising from your use of the Services. Where liability cannot be excluded, our total liability is limited to the amount paid for the relevant order.

18. Indemnification

You agree to indemnify and hold harmless SleepCurl and its service providers from claims arising from your breach of these Terms or misuse of the Services, to the extent permitted by law.

19. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force.

20. Assignment

You may not assign your rights under these Terms without our prior written consent. We may assign these Terms as part of a business transfer, merger, or reorganisation.

21. Governing Law & Disputes

These Terms are governed by the laws of The Netherlands. If you are a consumer residing in the EU or the UK, mandatory consumer protection laws of your country of residence may also apply. Any disputes shall be submitted to the competent courts of The Netherlands, unless mandatory consumer law provides otherwise.

22. Changes to These Terms

We may update these Terms from time to time. Updated versions will be posted on this page with a revised “Last updated” date. Continued use of the Services constitutes acceptance of the updated Terms.
